RUSH TO JUDGMENT

It has been brought to my attention that our neighbor, Donald Lundy, has been fighting a battle in court because of this website.  Donaldson Creek Hunting Camp is suing Mr. Lundy for libel and defamation.

Well, as it so happens, Donaldson Creek Hunting Camp is suing the wrong man.  In my opinion, in a rush to judgment, Donaldson Creek Hunting Camp is willing to strike out at anybody without having any facts to back it up.  The Camp is willing to drag an innocent man through court for the last year, just because it doesn't like him and presumes him to be guilty.  Again, no facts to back it up!  Now, understand, this is just my opinion.  Since I am the website developer, I can say with absolute certainty that Mr. Lundy is innocent in this case.

Donaldson Creek Hunting Camp maintains in public court records that the basis of the lawsuit is that Anthony Rustin is not a part owner of Donaldson Creek Hunting Camp.  To those of you who know them, you know the truth.  To those of you who don't, well...you'll have to form your own opinion.  With that thought in mind, I'm willing to change my website to reflect that ascertion.  In addition, I'll be posting the public court records for the lawsuit against Mr. Donald Lundy.  You know, Freedom of Information, First Amendment Rights and all that.

Donaldson Creek Hunting Camp is located in Western Kentucky in the community of Creswell in Caldwell County.  At the inception of the hunting camp the members of our community were proud to welcome folks to our neighborhood and we were happy to see local men prosper.  That attitude has changed with the unsafe practice of placing hunters within viewing distance of our homes where our children are playing in our yards.  We no longer welcome out of state hunters here and will do everything in our power to make your hunting experience as unsuccessful as possible.

Anthony Rustin was arrested on September 29, 2006 and charged with Trafficking Marijuana Over Five Pounds (Firearm Enhanced) 1st Offense and Possession of Drug Paraphernalia (Firearm Enhanced) 1st Offense.  The Kentucky State Police searched Donaldson Creek Hunting Camp, with permission, in connection with this raid.  Donaldson Creek Hunting Camp has since the arrest stated in public court records that Anthony Rustin is not an owner of Donaldson Creek Hunting Camp.  So, nobody knows why the hunting camp was raided. 

December 1, 2009, Anthony D. Rustin was sentenced by Judge Clarence Woodall to five years on trafficking in marijuana more than five pounds and 12 months on drug paraphernalia possession to run concurrent. A motion was granted for appellant bond of $10,000 cash or $20,000 property.


On December 3, 2009, Anthony D. Rustin filed an appeal with the Kentucky Court Of Appeals.
